1. Introduction
Welcome to Pashu App, an online marketplace operated by Pashu App Technologies ("Pashu App", "we", "us", or "our").
Pashu App provides a platform where users can discover, publish, search for, and communicate about animal listings and related services.
These Terms & Conditions ("Terms") govern your access to and use of the Pashu App mobile application, website, and related services.
By accessing or using Pashu App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the application or related services.
2. Eligibility
You must meet the minimum legal age and eligibility requirements applicable in your jurisdiction to use Pashu App and enter into transactions through the platform.
By using Pashu App, you represent that:
You have the legal capacity to enter into these Terms.
The information you provide is accurate and up to date.
You will comply with applicable laws and regulations.
You will use the platform only for lawful purposes.
3. Pashu App as a Marketplace Platform
Pashu App is a technology platform that facilitates interactions between users.
Unless expressly stated otherwise, Pashu App Technologies is not the owner, seller, buyer, breeder, transporter, veterinarian, agent, or representative of animals listed by users.
Transactions, communications, negotiations, inspections, payments, transportation, delivery, and other arrangements between users are primarily between the relevant users.
Important: Pashu App does not guarantee the identity, ownership, health, breed, age, quality, condition, legality, availability, or suitability of any animal listed by a user.
4. User Accounts
Certain features of Pashu App may require you to create an account.
You are responsible for:
Providing accurate registration information.
Keeping your account information up to date.
Maintaining the security of your account.
Keeping authentication credentials confidential.
All activity carried out through your account, except where caused by unauthorized access that was not reasonably preventable by you.
You must notify us promptly if you believe your account has been accessed without authorization.
5. Listings
Users may be able to create listings for animals or related products and services, subject to the features and rules of Pashu App.
When creating a listing, you agree that:
All information provided is truthful and accurate.
You have the legal right and authority to list the animal or item.
Photographs and videos accurately represent the listing.
The listed animal is not falsely represented.
The listing complies with applicable laws.
The listing does not contain prohibited or fraudulent content.
6. Prohibited Listings and Activities
You must not use Pashu App to publish, promote, sell, purchase, or facilitate unlawful or prohibited activities.
Examples include, but are not limited to:
Fraudulent or misleading listings.
Stolen animals or property.
Listings involving illegal animal trade.
Activities prohibited by applicable animal welfare laws.
Protected or endangered animals where prohibited by law.
Illegal wildlife trade.
Fake documents or forged certificates.
False veterinary or health claims.
Scams or deceptive transactions.
Money laundering or other financial crimes.
Spam or mass unsolicited communications.
Malware or malicious content.
Content that infringes intellectual property rights.
Content that is abusive, threatening, or harassing.
Sexually explicit or exploitative content.
Content involving child exploitation.
Attempts to manipulate ratings, reviews, or listings.
We reserve the right to remove content or restrict accounts where we reasonably believe these Terms or applicable laws have been violated.
7. Animal Health and Condition
Users are responsible for independently verifying the health, condition, breed, age, vaccination status, ownership, and other characteristics of an animal before completing a transaction.
Pashu App does not provide veterinary advice and does not guarantee the health or condition of animals listed on the platform.
Buyers should conduct appropriate inspections and, where appropriate, consult a qualified veterinarian before purchasing an animal.
8. Buyer Responsibilities
Buyers are responsible for conducting reasonable due diligence before completing a transaction.
Buyers should independently verify:
Seller identity and contact information.
Animal ownership.
Animal health and condition.
Breed and age information.
Relevant veterinary records.
Legal restrictions applicable to the animal.
Transportation and delivery arrangements.
Price and payment terms.
Pashu App is not responsible for losses resulting from a buyer's failure to conduct appropriate due diligence.
9. Seller Responsibilities
Sellers are solely responsible for ensuring that their listings and transactions comply with applicable laws.
Sellers must:
Provide accurate listing information.
Have legal ownership or authority to sell the animal.
Disclose material information known about the animal.
Use genuine photographs and information.
Comply with animal welfare requirements.
Comply with applicable transportation requirements.
Honor legitimate agreements made with buyers.
10. Transactions Between Users
Pashu App may facilitate communication and discovery between buyers and sellers but does not necessarily participate in the underlying transaction.
Users are responsible for determining and agreeing upon:
Purchase price
Payment method
Delivery or transportation
Inspection
Ownership transfer
Documentation
Refund or cancellation terms
Other transaction conditions
Pashu App does not guarantee that a transaction will be completed successfully.
11. Payments
Certain features or services offered through Pashu App may require payment.
Payment processing may be provided by third-party payment processors such as Razorpay or other authorized providers.
Additional fees, payment terms, taxes, and refund conditions may be displayed before a paid transaction is completed.
Payment processing may also be subject to the terms and policies of the applicable payment provider.

12. Refunds and Cancellations
Refund eligibility depends on the specific product, subscription, service, transaction, and applicable refund policy presented at the time of purchase.
Unless otherwise required by applicable law, payments made directly between users for an animal transaction are not automatically refundable by Pashu App.
Users should verify transaction terms before making payment.
13. Advertising
Pashu App may display advertisements provided by third-party advertising networks.
These may include Google AdMob, Unity Ads, Meta advertising services, and other advertising partners.
Pashu App does not necessarily endorse or guarantee products, services, or claims made in third-party advertisements.
Your interactions with advertisers are subject to the advertiser's own terms and policies.
14. User Content
You retain ownership of content that you submit to Pashu App, subject to the rights granted to us under these Terms.
By submitting content such as photographs, videos, listing descriptions, reviews, or other material, you grant Pashu App Technologies a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and distribute that content as reasonably necessary to operate, maintain, promote, and improve Pashu App.
You represent that you have the necessary rights to submit the content and that the content does not violate applicable law or the rights of others.
15. Content Moderation
We may use automated systems, manual review, reports, or other methods to identify potentially prohibited, fraudulent, unsafe, or inappropriate content.
We may remove, restrict, hide, or modify content that we reasonably believe violates these Terms, applicable law, or our platform rules.
We may also limit the visibility or functionality of an account while investigating suspected violations.
16. User-to-User Communications
Users may communicate with each other through features provided by Pashu App.
You agree not to use communication features to:
Harass or threaten other users.
Send spam or unsolicited promotional messages.
Conduct fraudulent activities.
Request sensitive information unnecessarily.
Distribute malware or malicious links.
Engage in unlawful activities.
17. Intellectual Property
Pashu App and its original content, software, design, trademarks, logos, graphics, interfaces, and other materials are owned by or licensed to Pashu App Technologies unless otherwise stated.
You may not copy, modify, reproduce, distribute, sell, reverse engineer, or commercially exploit any portion of Pashu App without prior written permission, except where expressly permitted by applicable law.
Pashu App and associated branding are trademarks or brand assets of Pashu App Technologies, where applicable.
18. Third-Party Services
Pashu App may integrate third-party services including Firebase, Google Play Services, Google AdMob, Unity Ads, Meta services, Razorpay, OpenStreetMap, and other services.
Third-party services may be governed by their own terms, licenses, and privacy policies.
We are not responsible for the independent actions, availability, policies, or practices of third-party service providers.
19. Account Suspension and Termination
We may suspend, restrict, or terminate an account if we reasonably believe that the user:
Violates these Terms.
Provides fraudulent or misleading information.
Engages in illegal activities.
Creates fraudulent listings.
Attempts to circumvent platform security.
Harms or threatens other users.
Uses the platform for abuse, spam, or scams.
Creates a security or legal risk for the platform.
We may also take action where required by applicable law or by a lawful request from an authorized authority.
20. Account Deletion
You may request deletion of your Pashu App account in accordance with the account deletion process provided by the application.
Deleting your account may result in the removal or deactivation of your listings, profile, and other account-associated content, subject to applicable law and legitimate retention requirements.
Information that must be retained for legal, security, fraud-prevention, accounting, dispute-resolution, or other legitimate purposes may be retained for the required period.
21. Prohibited Use of the Platform
You may not:
Use Pashu App for unlawful purposes.
Attempt to gain unauthorized access to systems.
Interfere with platform security or operation.
Use automated scraping or bots without authorization.
Reverse engineer the application where prohibited by law.
Upload malicious software.
Attempt to manipulate marketplace functionality.
Create multiple fraudulent accounts.
Impersonate another person or organization.
Use another user's account without authorization.
Attempt to circumvent account restrictions.
22. Availability of the Service
We aim to keep Pashu App available and reliable, but we do not guarantee that the application or any specific feature will always be available, uninterrupted, secure, or error-free.
The service may occasionally be unavailable due to maintenance, updates, technical issues, network failures, security incidents, or circumstances outside our reasonable control.
23. Disclaimer
Pashu App is provided on an "as available" and "as is" basis to the extent permitted by applicable law.
We do not guarantee:
The accuracy of user-generated listings.
The identity of buyers or sellers.
The health or condition of animals.
The availability of listed animals.
The legality of every user transaction.
The successful completion of a transaction.
The uninterrupted availability of the platform.
The accuracy or reliability of third-party services.
24. Limitation of Liability
To the maximum extent permitted by applicable law, Pashu App Technologies and its owners, directors, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Pashu App.
This may include losses arising from:
User-to-user transactions.
Fraud or misrepresentation by another user.
Animal health or condition.
Transportation or delivery issues.
Loss of profits or business opportunities.
Loss of data.
Service interruptions.
Third-party services.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
25. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Pashu App Technologies and its affiliates, directors, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:
Your violation of these Terms.
Your unlawful use of Pashu App.
Your listings or user content.
Your transactions with other users.
Your violation of another person's rights.
26. Disputes Between Users
Users are encouraged to communicate directly and attempt to resolve disputes relating to transactions.
Pashu App may, at its discretion, assist with reports or platform-related complaints, but we do not guarantee that we will mediate, resolve, or compensate for disputes between users.
Nothing in this section limits any rights available to consumers under applicable law.
27. Changes to These Terms
We may update or modify these Terms from time to time.
When changes are made, we will update the "Last Updated" date shown at the top of this page.
Where appropriate, we may provide additional notice through the application or website.
Your continued use of Pashu App after updated Terms become effective constitutes acceptance of the updated Terms, subject to applicable law.
28. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of India, subject to any mandatory consumer protection or other rights that cannot be excluded under applicable law.
Any dispute shall be subject to the jurisdiction of the competent courts having jurisdiction over the applicable location, subject to applicable law.
29. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable, where legally permitted.
The remaining provisions of these Terms will continue to remain in effect.
30. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms presented for specific services, constitute the agreement between you and Pashu App Technologies concerning your use of Pashu App.

32. Acceptance of These Terms
